Statement Regarding Labor Commission Decision

Today, June 15, 2020, the State Labor Commissioner issued a Decision in the Matter of Jane Does 1-5 vs. Direct Models, Inc. and Derek Hay following a hearing conducted in September and November 2019.  In a 55 page Decision, the Hearing Officer rejected 3 of the 10 Claims brought by the five Adult Entertainers.  However, the Commissioner awarded an aggregate amount of $24,206.49 for various breaches of the Exclusive Agency Agreements of the five performers, holding both Direct Models and its Owner, Derek Hay liable for the award.

Direct Models and Derek Hay will immediately file an Appeal for ‘trial de novo’ in the Los Angeles County Superior Court where the entire matter will be re-adjudicated after full and complete pre-trial discovery is permitted and conducted (the Labor Commission Hearing proceeded with no pre-hearing discovery depriving Respondents of a meaningful opportunity to address the allegations and charges).  The filing of the Appeal renders this Decision moot.

Derek Hay and his Attorney are disappointed in the initial findings of the Labor Commissioner but are confident that Derek Hay and Direct Models will be completely vindicated after a full and complete opportunity to answer the allegations in an actual Trial (a jury trial) with all the witnesses and all the evidence heard according to the Superior Court rules of evidence.

Contrary to the claims of the counsel of the Jane Doe women, “that he never seeks to try a case in the media”, he has in fact done exactly that throughout, as have his clients in a voluminous amount of postings on this case on social media and statements to many and varied adult industry media. This was self-evident from the very outset, when AVN was informed that the suit existed, some 17 days prior to the suit being served to us, even before we ourselves were able to actually read it.

Nonetheless, this case will not be tried in the media, but ultimately will be heard and adjudicated in a fit and proper trial in Superior Court.

The hearing before the Labor Commissioner had no pretrial discovery, and it was therefore not possible to mount a meaningful defense, having no idea of the evidence that would be brought forth to support the charges, and not least of which, that much of the evidence brought forth was standalone testimony by the Jane Doe’s, unsupported by any relevant documentation or other evidence with which to support it, and much of which, would be classified as hearsay in any other courtroom.

Whilst we always felt it would be very difficult to get a fair trial and a favorable outcome in the administrative hearing, and the nature of the hearing, finding us always working from the back foot,  we are nonetheless very disappointed at this finding, as we do not feel that the counts found against us were sufficiently proven, whilst three of them were dismissed. That said – at the same time, we always knew that the ‘ trial de novo’ is the avenue through which we will have an opportunity to examine the evidence in detail before trial and with the benefit of the provision of documents including phone and financial records aforehand and for which we will be afforded the opportunity to have pre- trial depositions of the plaintiffs (under oath), that is the process, by which this case will ultimately be determined.

We are very confident that the decision of the ‘trial de novo’ will be contrary to that of The Labor Commissioner, and that the name of Direct Models and that of my own personally, will be cleared of such charges at the final outcome of that trial.

According to an old old article on the Mike South website about Manwin being unable to buy up a talent agency because of a conflict of interest, I realized that Derek Hay and LA Direct Models has been doing that for a long time – I mean the conflict of interest part.

They have a direct interest in many of the girls personal websites and as such it would be a direct violation of California Labor Code section 1700.40.

 

(b) No talent agency may refer an artist to any person, firm, or corporation in which the talent agency has a direct or indirect

financial interest for other services to be rendered to the artist, including, but not limited to, photography, audition tapes, demonstration reels or similar materials, business management, personal management, coaching, dramatic school, casting or talent brochures, agency-client directories, or other printing.

(c) No talent agency may accept any referral fee or similar compensation from any person, association, or corporation providing services of any type expressly set forth in subdivision (b) to an artist under contract with the talent agency.

 

 

For years they’ve been violating US labor laws. Now this. Plus they’ve been double dipping, yet another violation (where they charge both the client and the talent booking fees. And that’s not even touching the whole escorting thing.

So why has nobody taken this jackass down yet?

HELLO? Plain and simple, he takes a percentage of money from the girls website. He has a DIRECT FINANCIAL INTEREST in them. How is this not a violation of the labor law?

This post I think I’ll devote to a subject that has been getting some attention lately. Agencies. It’s a touchy subject for discussion publicly mainly because most performers are worried about backlash in the form of economic reprisals from a few of the agencies. If you want my honest opinion, the porn industry needs to do away with this scam. You think an association of adult talent agencies has our best interests at heart? Really? Before I get into public slandering of a bunch of sociopathic bullies and manipulators, lets get right to the heart of the matter. The money.

 

For starters they take an agency commission of 15-20% of talent income. That means for every 1 million dollars doled out to pay talent, $200.000 of that goes to pay someone with no real talent to speak of other than sitting on their asses in front of a computer and doing what 90% of the industry talent used to do for themselves. And thats just the tip of the iceberg. We’ve all heard stories of buying out of the agency for a large fee. Are these contracts even legally binding? And what about the constant blacklisting that goes on against any talent that dare question their authority? Or for petty reasons that have more to do with pushing independent contractors out of the way to make room for their shitty b-list talent that’s too scared to rock the boat. How many of you listen to the same bullshit that comes out of their mouths (you need to lose weight, you need to get breast augmentation, you have to do this scene even though you are tired and sore, we have to hold your rate, you have to start doing anal scenes,etc.) and wanted to throttle them? How often do they get a needle in their arm and piss in a cup to test for work? How often do you see their lazy asses in the gym to stay fit for work? And thats just the shit I’ve been hearing for a few years now. Did they prevent Mr. Syphillis er Mr. Marcus from going to work with a forged test? Did they prevent the condom law from going into effect? Did they improve conditions on set? No they didn’t. They put 20% of our money into their own pockets and tried to tell us that we need them more than they need us. Well now we are in the middle of a crisis in our business and are they doing anything except lining their pockets? Fuck no. They’ve trashed the industry to the point where the girls are more hookers than entertainers. And that requires a lot of grooming to achieve. Most people are born with a little self esteem, these jack offs attack any sign of common sense and self preservation.

 

My experience with agents is summed up like this – they want a docile  bitch to go along with whatever hack set they send you to. And then they want a dumb dog to just shut the fuck up and do the job. I’ve been lied about rate, who I’m working with, and what type of scene I’ll be doing and I’m supposed to just go along with waiting a month for a check with their cut taken off. I have never authorized  any checks to be written to me by a a talent agency. They seem to think this is ok. What a joke. And they are also getting really efficient at grooming the girls away from any real communication with the other talent. That would breed discontent. It’s no wonder I only last a few scenes with an agent and then bail…

 

The agency licensing and bonding procedure they try to legitamize themselves through wasn’t designed for porn. It was designed for agents who deal with SAG or million dollar contracts in mainstream movies or television. We don’t make enough and most of our careers aren’t long enough to have some fucking parasite attached to us. And the shitty thing is they have taken so much power for themselves that most people think they are powerless to do something about it. Remember LATATA is only a recent thing and judging by the way the industry is going now I’d say it’s time for these parasite pimp scumbags to hit the fucking road. They’ve had their chance and they fucked up. Remember everyone – YOU CAN BOOK YOUR OWN SCENES!!

 

Porn wasn’t always like this. It was Jim South and 3 skeezy pimps until 2006. Most girls would do 5 scenes and figure out that they could book their own scenes and dictate the terms. Now you do it out of obligation. The only way to do porn is for yourself. Thats it.. Another way it’s changed is the girls had waaaaay more say in who they worked with. You knew who would show up be cool and rip through a scene with no problem. You knew that if you worked with an A list male talent, you weren’t going to catch an infection or be treated like shit. You knew he wasn’t injecting his dick with Caverject to maintain wood. Now you get some agency/Manwin propped up fraud that never had to really prove himself to begin with. There was natural order. The strongest guys with the strongest girls. The performers had a say in what was going on. Now it’s petty grooming and guilt by an agent. I don’t want to fuck an agency. I want to fuck the girl I’m working with. The director used to actually be concerned with who wanted to fuck who. Nobody cared.It was that simple. Now it’s a fucking joke. And the joke is on you….

 

LA Direct Models Hired Illegal Workers

As news broke today that some rich bitch in New York is going down for what they are saying as “encouraged and induced an illegal immigrant to work and reside in the country” it hit me that Derek Hay of LA Direct Models is doing exactly the same thing when he encourages girls from the UK to come stay at his model house and work in the US, without legal papers to do so.

The girls from the UK probably don’t even realize they are breaking the law, but Derek Hay knows.  Derek Hay of LA Direct Models has been thumbing his nose at the law for years.  Will this violation of the law finally be the thing that gets him busted?  I mean if the hooking thing didn’t then maybe hiring illegal aliens will.

If you are not a US citizen then you must obtain a work permit to work in the United States and knowingly securing work for someone without a valid work permit is illegal.

As an agent, LA Direct Models has been doing just that for awhile now but more specifically last month by securing work for UK performers Emily B and Lou Lou who my sources say recently came to the US to work on a tourist visa for two weeks in January during the time of the AVN show in Las Vegas and from February 10 – 22nd.

But even more interesting is not only did he secure work for these two girls who were not authorized to work in the US, he hired them himself to work on his website, Direct Models Live in association with their collection of websites run through Premium Cash.

While I don’t know all of the jobs he booked the UK girls on, we know for sure they did work for both Hustler and Brazzers.  And even more interesting there are rumors (via some ominous tweets) that at least one of the girls are now struggling to get paid by some of the jobs LA Direct Models booked for them.

We can’t let the year end without one hell of a rumor now can we?

Here is one that was emailed to me recently.

Derek Hay, owner of LA Direct Models (aka porn star Ben English) is violating the Mann act law by hooking girls in the UK (see link here) and importing illegal aliens and getting them ID cards to work illegally in porn in the USA.

For those of you who don’t know,the Mann act is a law which in its original form prohibited white slavery and the interstate transport of females for “immoral purposes”. Its primary stated intent was to address prostitution, immorality, and human trafficking. While its ambiguous immorality language allowed selective prosecutions for many years, it was later amended by Congress to apply only to transport for the purpose of prostitution or illegal sexual acts.

So what now is the tally here on Derek Hay profiting from his talent?

He makes money from the producers who want to book the stars.  He then charges the talent a cut for booking them for the job.  He charges then 20% to run their website, plus makes them do scenes for their sites and others in the premium cash network for free, he profits by booking himself as male talent in movies with the girls he represents from the agency and before you say he retired, BULLSHIT, I know just last month for a fact he was doing a scene.  And now there is the hooker fees, that money from which he makes off of the girls for having them escort for him.

I’ve been noticing Lisa Ann tweeting some nasty shit about Derek Hay and the Lee Network lately and I thought to myself, aren’t they supposed to be partners. I remember reading several articles on this. So her tweets were a little confusing to me.

in 2008 i took on a partnership with The Lee Network to help out Tony Lee after a split with his previous agents. At the last minute it became a partnership with Tony Lee and Derek Hay ( yup its still Boys Town in the business and i don’t think Tony Lee was comfortable having a woman as his sole partner)… BUT Tony Lee and Derek Hay were perfectly fine having me front all the money for the company bills, advertising and employee. In 2009 after a dispute with Derek Hay, i was told i was no longer a partner and the office and books would now be run out of LA Direct Models. At this point i had put in about 25,000. of my own money. During this time The Lee Network was still collecting commission from me when i was Feature Dancing and made me an offer to raise my commission, but allow ME to keep half of the commission to begin to offset my debt. So i am at that point now Dancing off my own loan from them. We finally agreed on also paying me $500 a month to pay off the debt. After 6 month of NO payments i left the Lee Network as a Feature Dancer, and went full time with A LIST Features, who i am VERY happy with.. BUT then i was told by Derek Hay “since you rode off into the sunset with our competitor, you will be getting no more payments of $500, you can just write it off as a bad investment” … that was that. That was April 9th of 2010. That money i loaned The Lee Network also affected ,y financial security at Lisa Ann’s Talent Management, since i borrowed the money from one Agency to another.

NOW we are here, and they are both aware i have my documents in order and am prepared to sue. Oddly on June 18th i received a check dated June 8th for $500. in the note section of the check from LA Direct Models/ The Lee Network the check said Jan 2010 payment. So obviously admitting you are 6 months late on a payment is somewhat acceptable to The Lee Network, not to me, or my lawyer, This should be a pretty easy case, just time consuming and expensive, but out of principal, worth it.
Last weekend i had my last Booking thru the Lee Network, it was booked over 6 months ago, and unlike them, i stick to my commitments, when i went to get paid, the club had a different contract than the one i signed, theirs wasnt signed at all by me, and the commission amount i was charge was more than i agreed on, so again The Lee network took more money from me.
the ad part here is this, The Lee Network put food on my table for years, when they were struggling, the only right thing to do would be to help. i was wrong, the silver lining in this is A LIST FEATURES is getting me better bookings, treating me very well, and i am winning more Awards than ever, so it helps them in booking me.

There is no other choice than to take The Lee Network to court, unless they would come to their senses and just pay. BUT that thought is just comedy!!

Thank you to the editor for the opportunity to respond, – one should always remember there are two sides to every story,  It is a shame that Lisa Ann chooses to air ‘dirty laundry’ in public – I do not choose to do the same.
However, for the record Ms Ann was at no time a partner in the Lee Network, nor has LADirect Models accepted any monies from nor repaid any monies to, Ms Ann.

I find it funny that Derek Hay would say this when it has been well documented in news stories on the internet. XBiz reproted:

But he claims they were never partners?? I’m a little confused. And if they never paid her any money, why would she lie that she has check stubs. That is so easily provable. She plans on using them in court. I mean I am all for the there is two sides to every story buy come on, you don’t have to lie! This is a very interesting case of he said/she said. Brooke Haven Birthday Bash Turns Ugly

Brooke Haven recently had a birthday party.  With the help of her friends over at LA Direct Models, Brooke Haven hosted a party with 50 or so of her industry friends.   It was a night meant for fun and frolic …. but then something went wrong, very wrong and ended with War Machine wanted by the law, Ben English in the hospital, some asian dude with a broken nose and Alec Knight with stitches in his head.   Although it is unclear exactly what injuries Ben English / Derek Hay has, he is said to still be in the hospital “recovering”.  So what the hell happened?  Well …. that’s where it gets a little confusing.

I read the original story on Adult FYI.  In short, War Machine – MMA fighter turned porn star hit his girlfriend at the Brooke Haven bash.  War Machine’s girlfriend, at least according to the story at Adult FYI is Alanah Rae.  Alanah Rae is still rather new to the business, having been around only about a year and in that time doing about 2 to 3 movies per month.  So she’s not completely unheard of, but still rather green.

Anyway, back to the story.   War Machine smacked his girlfriend in the face.  Then as others tried to find out what was going on and asked him to mellow out, he went after them as well.  Reports state he just went crazy and started going after anyone and everyone but with all of the attention on the fact that he went after his agent, people are glazing over the fact that this dude his his fucking girlfriend.  What kind of man would do something like that?  And even more serious, what kind of company would hire a man who does that?  That’s some fucked up shit.

Who is this War Machine you ask?  Well according to his Wikipedia page War Machine was born Jonathan Koppenhaver on November 30, 1981 and is professional mixed martial artist (MMA fighter).   He was formerly a fighter on The Ultimate Fighter:  Team Hughes vs. Team Serra.

The Ultimate Fighter season six cast member Jon “War Machine” Koppenhaver legally changed his name to War Machine after a dispute erupted with TNA Wresting over the use of his nickname (War Machine) as there is also a wrestler who once used to go by the same name.  When he made the legal move he made a blog post about it.  Here is a copy of that post.

The Grand Vizier woke me up out of a sound slumber early Sunday morning and just gave me these highlights with promise of more to follow:

“This looked like something out of a bad Vince McMahon script as this guy War Machine went nuts and began taking everyone on at this party,” The Vizier says. “We’re talking multiple assaults and battery with the cops after him.”

“War Machine’s own agent, Derek Hay, looked to be the primary target with a couple of shots to the head. Mika Tan’s Ex was KO’d as well & sent to hospital.”

I spoke to The Grand Vizier late Sunday afternoon, and he was telling me the War Machine incident occurred at a private birthday party at the Ultimate Porn Studios on Hayvenhurst near the Van Nuys airport. The shindig was for Brooke Haven and Glen, the webmaster for the MeanBitches website.

The fight, according to The Vizier broke out near midnight, but there was already a weird vibe due to the fact that it was reported earlier that David Aaron Clark had died.

“There were maybe 50 to 60 people at the party,” states The Vizier.

“Apparently War Machine wasn’t too happy, claiming that Derek Hay wasn’t getting him enough work as far as he was concerned. What happened next was speculative. Either War Machine socked a girl or was accused of doing it. Either way he snapped and began doing an Octagon dance and waving his fists. One guy was clocked and had three teeth knocked out. Another guy- an Asian- had his nose broken.

“Then War Machine came after Derek and knocked him down. Alec Knight was also hit and went down, his head striking the pavement. It seemed that every time someone tried to advise War Machine to mellow out or tried to talk sense to him, they got hit for their efforts. Maybe six guys in all got punched. War Machine was relentless as the crowd kept a distance.”

I have to give little Miss Darah Ford credit again. She’s posted a great story on Derek Hay and friends skirting the law yet again. Darrah Ford recently got a tip about Derek Hey from LA Direct Models as well as a few others teaming up, having a fund raiser with a non profit organization, half of the money went to the real non profit organization, they kept the other half for their group. Problem is, it’s against the law. Here is the full story is below.

Is it legal?

A lot of people are making a big deal about the AIM Fundraiser, but someone on adultdvdtalk asks a good question:

“HALF of the money goes to AIM, the other half goes to LATATA (Derek Hay, Joel Lawrence, Type9 etc.)

So if you want to give money to porn agents then by all means show up. If you want to give money to AIM, just go to their website and do it there, or just send them a check.

This is great, holding a fundraiser for AIM and keeping half the money. I challenge LATATA to give ALL the money to AIM. (is this legal, a 501c3 and a for profit organization combing a fundraiser under the guise of helping the nonprofit) Pornlaw, what do ya think?”

A fundraiser for the Licensed Adult Talent Agency Trade Association (L.A.T.A.T.A.) and the Adult Industry Medical Healthcare Foundation (A.I.M. Healthcare) is going to be held on Wednesday, November 11th 2009 @ Les Deux Nightclub in Hollywood, Ca at 9pm.

Recently, the A.I.M. Healthcare Foundation has been the target of aggressive attacks by the Los Angeles County Department of Health (LACDH) and California Occupational Safety and Health Administration (Cal-OSHA). Motivated by LA County Health’s desire to get new funding and power to oversee all adult entertainment production, these began by inspection and probing of three (3) licensed talent agencies, by both LACDH and Cal-OSHA, seeking to obtain records on their producer clients and demanding the disgorgement of such records under the threat of issuance of citation for minor office space, work place violations. They did not do it! They hired attorneys and unified behind LATATA to protect themselves and the industry.

The industries first HIV positive case in five years was then identified in Patient Zero and the governmental effort re-focused on A.I.M. Healthcare because of the central nature of A.I.M. Healthcare to adult talent. As a result, A.I.M. Healthcare has now been embattled in a number of time consuming and expensive law suits to defend its very existence and protect its performer clients and their private medical records from such overreaching governmental intrusion.

Time to fight back! This fundraiser will help the adult industry in it’s fight against the very people that threaten to shut down A.I.M. Healthcare and, in effect, the progress of the adult industry in general! Awareness and support for this event is crucial and these proposed governmental obstructions would affect everyone in the industry from the production companies, agencies, talent, and studios etc.

Nine agencies have joined forces to help create extra money for this cause: L.A. Direct Models, GoldStar Modeling, Adult Talent Managers, Lisa Ann’s Talent Management, Spiegler Girls, Type 9 Models, World Modeling, A-List Talent, and Foxxx Modeling.

This is a red carpet event that will be hosted by representatives from each of the adult agencies. A star studded, who’s who of adult industry performers will be on hand to help raise proceeds.

Door proceeds for this event will be split equally between LATATA and AIM; donations to AIM alone at the event are most welcome and can be made with checks payable to AIM Healthcare Foundation.
